During the inaugural session of a seven-member panel chaired by retired Justice S.A. Omonuwa, set up by Chief Judge Justice Daniel Okungbowa to investigate Shaibu's conduct, the Assembly formally presented its case. The Assembly's deputy clerk, Joe Ohaifa, highlighted the grounds for impeachment, citing a petition alleging perjury and divulging state secrets filed against Shaibu.
Ohaifa pointed out that Shaibu allegedly disclosed sensitive government details in an affidavit submitted in support of a lawsuit in Abuja and submitted documents related to State Executive Council meetings, breaching his oath of secrecy and violating constitutional provisions.
Following the Assembly's presentation, the impeachment panel adjourned until Thursday for Shaibu to present his defense. However, Shaibu's lawyer, Prof. Oladoyin Awoyale (SAN), withdrew from the hearing after the panel rejected his plea to suspend proceedings pending the outcome of a suit filed in a Federal High Court in Abuja.
Despite Awoyale's argument that the court had scheduled a hearing on April 8 to consider halting the impeachment, the deputy clerk asserted the Assembly's constitutional duty to proceed with the investigation. The panel chairman, Justice Omonuwa, echoed this sentiment, clarifying that the court's invitation did not impede the impeachment process.
In response, Awoyale expressed Shaibu's inability to continue participating in the investigation and sought permission for his client's absence. He emphasized the obligation to comply with the court's decision, maintaining the necessity to appear before it on April 8.
