A magistrate court orders a lady to pay a fine of Ksh25,000 or serve a three-month jail term for failing to display ‘alcohol not for sale for persons under 18’ at her liquor shop

 


A liquor store owner in Mombasa, Kenya, was taken into custody for failing to post a sign stating that alcohol is not offered to customers under the age of 18.

In front of Mombasa Senior Resident Magistrate David Odhiambo, Betty Makena, who owns a wine and spirits store, admitted guilt to the allegations. 

The charge sheet stated that the owner of the aforementioned liquor store, Betiz Wines and Spirits, in the Black Devil neighbourhood of the Jomvu sub-county of Mombasa, "failed to display a prescribed warning sign informing members of the public that sale of the available alcoholic drinks for persons under the age of 18 years was prohibited by law" on July 25, this year at approximately 22:46.

Makena was also charged with a second count of selling alcoholic beverages without a liquor licence in violation of Sections 62 and 7(1)b of the 2010 Alcoholic Beverage Control Act.

She was given a K25,000 fine or a three-month jail sentence by the magistrate. She had 14 days to file an appeal of her punishment.
